Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the Three Springs Farm website at www.threespringsfarm.com (the “Site”), the Three Springs CSA Member App (the “App”), and any
related services, including our Community Supported Agriculture (CSA) program and SMS notifications (collectively, the “Services”), offered by Three Springs Farm (“we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, place orders, or enter into agreements through the Services. By using the Services, you represent that you meet this requirement.

3. Accounts

Some features require you to create an account. When you do, you agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential
• Notify us promptly of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been involved in fraudulent or abusive activity.

4. CSA Memberships, Orders, and Payments

Our CSA memberships, share options, pickup and delivery arrangements, and pricing are described on the Site or App at the time of purchase. By placing an order or signing up for a membership, you agree to the specific terms presented at
checkout (such as share size, season dates, pickup location, and pricing).

• Payment: Payments are processed securely through Stripe. You agree to provide valid payment information and authorize us to charge the amounts shown at checkout.
• Availability: Produce and other farm goods are subject to seasonal availability and weather conditions. If a particular item is unavailable, we may substitute a comparable item of equal or greater value.
• Cancellations and Refunds: Cancellation and refund terms for each membership or order are provided at the time of purchase. Please contact us with any questions.

5. SMS Notifications

SMS notifications are an optional service available to members who opt in. Your use of that service is also governed by our SMS Notification Terms and Conditions and our Privacy Policy,
which are incorporated into these Terms by reference. Highlights:

• SMS opt-in is never required to purchase goods or services from us.
• Message frequency may vary. Standard Message and Data Rates may apply.
• You may reply STOP at any time to opt out, or HELP for help.
• We will not share mobile information with third parties for promotional or marketing purposes.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Services, other users’ accounts, or our systems
• Interfere with or disrupt the Services, including by introducing viruses, malware, or excessive automated traffic
• Copy, reproduce, scrape, or redistribute content from the Services without our written permission
• Impersonate another person or misrepresent your affiliation with any person or entity
• Use the Services to harass, abuse, or harm another person

7. Intellectual Property

The Site, the App, and their content — including text, graphics, logos, photographs, and software — are owned by Three Springs Farm or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited,
non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

8. User-Submitted Content

If you submit content to the Services (for example, notes on your order, special requests, or messages to us), you grant us a non-exclusive, worldwide, royalty-free license to use that content for the purpose of providing and improving the
Services. You represent that you have the right to submit such content and that it does not violate the rights of any third party.

9. Third-Party Services and Links

The Services may include links to or integrations with third-party services, such as Stripe, Firebase/Google, Expo, and our SMS providers. We are not responsible for the content, policies, or practices of those services. Your use of them is
governed by their own terms and privacy policies.

10. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and
non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any information or content will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, Three Springs Farm, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill,
arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or $100 if
you have not made any payments.

12. Indemnification

You agree to indemnify and hold harmless Three Springs Farm and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of the rights of any third party
• Information you provide that is inaccurate, incomplete, or misleading

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services. You may stop using the Services and request account deletion at any
time by contacting us. Sections of these Terms that by their nature should survive termination (such as Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and, for material changes, provide notice through the Services or by email. Your continued use of the Services after the updated Terms take
effect constitutes acceptance of the changes.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located
in Oklahoma, and you consent to the personal jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our
Privacy Policy and our SMS Notification Terms and Conditions, constitute the entire agreement between you and Three Springs Farm regarding the Services.
